Nagpur News : नागपुरातील लेआऊटमधील सार्वजनिक वापराच्या मोकळ्या जागा चिंचमलातपुरे यांनी मुलाच्या नावावर केल्याने नागरिकांनी हायकोर्टात धाव घेतली आहे. यावर निर्णय घेण्यासाठी हायकोर्टाने नागपूर सुधार प्रन्यासला 6 आठवड्यांचा वेळ दिला आहे. मुख्यमंत्र्यांनी झोपडपट्टीवासियांसाठी बांधण्यात येणाऱ्या निवासी गाळ्यासाठी अधिग्रहित जमीन 16 जणांना वितरित करण्याचा निर्णय हिवाळी अधिवेशनात गाजल्यानंतर हा आदेश परत घेण्याची नामुष्की राज्य सरकारवर आली होती. त्याचप्रमाणे नागपूर सुधार प्रन्यासने (नासुप्र) Nagpur Improvement Trust अस्थायी मंजुरी दिलेले चार मोकळ्या जागांचा वाद हायकोर्टात पोहोचला आहे. 

शहरातील मानेवाडा परिसरातील ‘ग्रीन प्लॅनेट कॉलनीत’ मंजूर अभिन्यासाच्या परिसरात सार्वजनिक वापरासाठी 4 मोकळ्या जागा ठेवण्यात आल्या होत्या. परंतु, लेआऊटधारक रामभाऊ चिंचमलातपुरे व विजय चिंचमलातपुरे यांनी या मोकळ्या भूखंडावर संरक्षण भिंत उभारुन अवैधपणे भूखंड केले. तसेच, हे भूखंड मुलाच्या नावे विक्रीपत्रही करुन दिले. 2014 मध्ये या भूखंडांना नियमित करण्यासाठी नासुप्रकडे अर्ज करण्यात आला होता. हे चारही भूखंड लेआऊमध्ये नसल्याने तसेच सार्वजनिक उपयोगाच्या जमिनी नसल्याने प्रन्यासने 16 ऑगस्ट, 2014 मध्ये अर्ज फेटाळला होता. परंतु, नासुप्रने आता हायकोर्टाच्या आदेशाचे उल्लंघन करत या भूखंडांचे नियमितीकरण केले आहे. विशेष म्हणजे चिंचमलातपुरे यांच्याकडूनच या भूखंडांवरील अतिक्रमण काढणे अपेक्षित होते. परंतु, भूखंडांवर ताबा न हटवल्याने चिंचमलातपुरेनगर नागरिक कृती समितीने हायकोर्टात जनहित याचिका दाखल केली होती.

6 आठवड्याचा अवधी

याचिकेवर सुनावणीवेळी प्रन्यासने आपली भूमिका स्पष्ट केली. यात 3 जुलै, 2019 ला ग्रीन प्लॅनेट कॉलोनी लेआऊटला तात्पुरती मंजुरी प्रदान करण्यात आली. यासंदर्भात अद्यापही अंतिम निर्णय घेण्यात आलेला नाही. यावर कोर्टाने 4 आठवड्यात अंतिम निर्णय घ्यावा, असे निर्देश दिले. या आदेशानुसार प्रन्यासने 13 जून, 2019 रोजी नियमितीकरण अर्ज फेटाळत लेआऊट प्लान जैसे थे ठेवला होता. प्रन्यासच्या निर्ण्यानुसार सार्वजनिक वापरासाठी जागा अद्यापही कायम आहे. नासुप्रच्या या निर्णयामुळे 10 फेब्रुवारी, 2021 रोजी हायकोर्टाने 6 आठवड्यात अतिक्रमण काढण्याचा निकाल दिला. त्यानंतरही दीर्घकाळ लोटला. परंतु, अतिक्रमण कायम आहे.

पुन्हा केला अर्ज

चिंचमलातपुरे भावंडांनी 22 मार्च, 2022 रोजी पुन्हा एकदा नियमितीकरणासाठी अर्ज केला. यावर चिंचमलातपुरेनगर नागरिक कृती समितीने लेखी आक्षेप नोंदवला. सोबतच हायकोर्टाच्या आदेशाचे पालन न केल्यास अवमान याचिका दाखल करण्यात आली. यावर नासुप्र (NIT) व मनपाला (Nagpur Municipal Corporation) नोटीस जारी करण्यात आली आहे. अवमान याचिका प्रलंबित असल्यानंतरही नासुप्रच्या अधिकाऱ्यांनी नियमितीकरण करण्यात आल्याचे पत्र देण्याचा आदेश जारी केला आहे, हे विशेष.

भूखंड वितरणात गैरप्रकार झाल्याचा आरोप!

नागपूर सुधार प्रन्यास (नासुप्र) NIT भूखंड वितरण घोटाळ्याबाबत हायकोर्टात (High Court) दाखल याचिकेवर न्यायालयाने नियुक्त केलेल्या सेवानिवृत्त न्या. एमएन गिलानी समितीने अहवाल सादर केला होता. यात अनेक संस्थांना वितरीत करण्यात आलेल्या भूखंड वितरणात (Allotment of Land) गैरप्रकार झाल्याचे या अहवालात खुलासा करण्यात आला होते. यात अवैधपणे वितरण, नियमांचे उल्लंघन करणाऱ्यांविरूध्द कठोर कारवाई करीत त्याचा व्यावसायिक वापर करणाऱ्यांना कुठलीही सूट न देण्याचा नमूद केले होते. शिवाय, वितरित केल्यानंतर मोकळे पडून असलेल्या 20 भूखंडास प्रन्यासनं तात्काळ प्रभावाने परत घ्यावं असंही अहवालात नमूद करण्यात आलं होतं. सामाजिक कार्यकर्ते अनिल वडपल्लीवार यांनी यासंदर्भात याचिका दाखल केली होती. न्यायालय मित्र आनंद परचुरे यांनी 18 नोव्हेंबर, 2022 रोजी वृत्तपत्रात प्रकाशित जाहिरातीसोबत (Advertisement in Newspaper) अर्ज दाखल केला होता. यात मुख्यमंत्र्यांनी (Chief Minister of Maharashtra) प्रन्यासला आदेश देत झोपडपट्टीवासियांसाठी बांधण्यात येणाऱ्या निवासी गाळ्यासाठी अधिग्रहित जमीन 16 जणांना वितरीत करण्याचा उल्लेखही होता. त्यानंतर नागपुरात झालेल्या हिवाळी अधिवेशनातही हा मुद्दा गाजल्यानंतर हा आदेश परत घेण्याची नामुष्की राज्य सरकारवर आली होती.
